TCP is pleased to offer the following warranty covering EcoVations™
Fixture Body, TCP fluorescent lamps, and TCP T8 linear fluorescent electronic ballasts.

TCP warrants that T8 lamps and ballasts abide by their respective published specifications and are free from defects in material, workmanship and title. 

This warranty only applies when an TCP fixture is used with TCP lamps, which are operated on TCP T8 linear electronic ballasts that have been correctly wired and installed; are operated within the electrical values publicized on the ballast label; used in lighting equipment designed and approved for the application and in environmental conditions (temperature, humidity, and air movement) within the normal specified operating range of the system.

TCP warrants the fixture to be free from defect in manufacturing, under normal and proper storage, installation, and use, for a period of three (3) years after the date of purchase.  Our guarantee liability extends only to the repair or replacement of the defective fixture body part, and no labor charges for correction of the defect by repair or replacement will be paid by TCP unless prior written authority has been granted by our Quality Department.

If lamps in the systems meeting the above requirements fail due to factors within the lamp during the initial three (3) years or 10,500 hours of operation, whichever comes first, after the date of purchase, TCP agrees to supply replacement lamps at no charge.  This warranty applies to lamps which are operated on a burning cycle of 10 hours/start or more.

If a TCP T8 linear fluorescent electronic ballast and/or lamp fails due to factors within the ballast during the initial five (5) years, and/or lamp during the initial three (3) years or 10,500 hours of operation, whichever comes first, after the date of purchase, it is covered by this warranty. TCP, at its option, will at no charge either replace the defective T8 ballast, including paying a labor allowance of a maximum $10.00 per ballast and/or $1.00 per lamp, or refund the purchase price of the ballast. In addition, TCP covers the fixture body with a 3 year limited warranty.

Operation of this lamp/ballast system in frequently-switched applications (5 or more cycles per day) or in conjunction with automated controls (such as, but not limited to, occupancy sensors) will void this warranty.  These lamp and ballast warranties do not apply to failures caused by acts of God, or as a result of any abuse, misuse, abnormal use, or use in violation of any applicable standard, code, or instructions for use in installations including those contained in the National Electrical Code (NEC), the Standards for Safety of Underwriters Laboratory, Inc. (UL), Standards for the American National Standards Institute (ANSI) or, in Canada, the Canadian Standards Association (CSA).  TCP reserves the right to inspect failed lamps and/or ballasts to determine the cause of failure and patterns of lamp usage.  The date of purchase and lamp installation date must be verified to validate the elapsed operating hours if a warranty claim is made.  If the lamp life is not validated, the lamp date code will be used to establish elapsed burning time based on estimated usage.

TCP shall not be liable for damages that result from deliveries that do not occur within a customer’s specified time frame or for any delay or default in delivering products where occasioned by any cause beyond the control of TCP, including without limitation embargoes; shortages of labor, raw materials, or fuel; fires; floods; accidents; acts of war; or other similar causes.

The foregoing shall constitute the exclusive remedy of the purchaser and the sole liability of TCP for T8 lamp and ballast warranties. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS MADE OR IS TO BE IMPLIED. In no event shall TCP be liable for any other cost of damages including lost profits, incidental, special or consequential damages.
